1. Acceptance of Terms

These Terms of Service (“Terms“) govern your access to and use of MarissaFayer.com and its subdomains (collectively, the “Site“), operated by Fayer Consulting LLC (“we,” “us,” or “our“), a limited liability company organized under the laws of the State of New York, with its principal place of business in New Rochelle, New York.

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Site.

2. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable local, state, national, or international law or regulation
  • Attempt to gain unauthorized access to any portion of the Site, its servers, or any systems or networks connected to the Site
  • Use any automated system, including bots, scrapers, or spiders, to access the Site for any purpose without our express written permission
  • Interfere with or disrupt the integrity or performance of the Site or the data contained on it
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Transmit any material that contains viruses, malware, or any other harmful code

3. Intellectual Property

3.1 Our Content

All content on the Site, including text, graphics, logos, images, photographs, audio, video, data compilations, and software, is the property of Fayer Consulting LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

The book Undervalued to Unavoidable: Women’s Health as Infrastructure, its content, excerpts, frameworks, and associated materials are the copyrighted work of Marissa Fayer and Fayer Consulting LLC. All rights are reserved.

3.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include the right to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content, information, or services obtained from the Site without our prior written consent.

3.3 Trademarks

“Marissa Fayer,” “HERhealthEQ,” and any associated logos, product names, and service names displayed on the Site are trademarks or registered trademarks of Fayer Consulting LLC or their respective owners. You may not use any trademark displayed on the Site without the prior written permission of the trademark owner.

4. Purchases and Payments

4.1 Products and Pricing

The Site may offer books, digital downloads, and other products for purchase. All prices are listed in United States Dollars (USD) unless otherwise indicated. We reserve the right to change prices at any time without notice. Pricing errors do not obligate us to fulfill orders at the incorrect price.

4.2 Payment Processing

Payments are processed securely through Stripe via our GoHighLevel checkout infrastructure. By making a purchase, you agree to provide accurate and complete payment information. We do not store your full credit card number on our servers. All payment processing is handled by Stripe in compliance with PCI-DSS standards.

4.3 Order Confirmation

When you place an order, you will receive an email confirmation. This confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity.

4.4 Refund Policy

Digital products sold directly through the Site, including downloadable guides, frameworks, and other digital resources, are non-refundable once delivered or made available for download.

Books are published and distributed through third-party platforms, including Amazon Kindle Direct Publishing (KDP) and IngramSpark. We do not process book returns or refunds directly. For all book purchases made through third-party retailers, the retailer’s own return and refund policies apply.

Presale purchases made through the Site are non-refundable once the order has been confirmed, except where required by applicable law. If you experience a technical issue with a presale transaction processed through Stripe, contact us and we will work to resolve it.

Nothing in this section limits any rights you may have under applicable consumer protection laws.

5. Email Communications

By providing your email address through any form on the Site, you consent to receive email communications from us. These may include newsletters, book updates, event announcements, promotional offers for products and services, information about speaking and consulting opportunities, and other marketing communications related to our work in women’s health and leadership. All emails will include an unsubscribe link, and you may opt out at any time by clicking that link.

We use single opt-in for email subscriptions. By submitting your email address, you confirm that you wish to receive communications from us.

6. SMS Messaging Terms & Compliance

By opting into our SMS messaging services, you agree to these terms governing text message communications from Fayer Consulting LLC. We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.

6.1 Program Description 

This messaging program sends appointment reminders, service updates, and promotional offers to customers who have opted in via https://marissafayer.com. Users provide explicit consent by checking an optional SMS consent checkbox when submitting the Contact Form.

6.2 Cancellation Instructions 

You can cancel the SMS service at any time by texting “STOP” or “UNSUBSCRIBE” to the number that sent you messages. You will receive a confirmation message, and no further messages will be sent unless you opt back in. Opting out of text messages will not affect your ability to use other services or receive communications via email.

6.3 Support Information

6.4 Carrier Liability 

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your mobile carrier’s network availability and is outside of our control.

6.5 Message & Data Rates 

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your engagement and the services you use. You may receive up to 4 messages per month for non-marketing communications, and up to 8 messages per month if you opt in to marketing communications. For questions about your text plan or data plan, contact your wireless provider.

6.6 Supported Carriers 

Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

6.7 Age Restriction 

You must be 18 years or older to participate in our SMS program.

7. Third-Party Links and Services

The Site may contain links to third-party websites, including but not limited to Amazon, book retailers, social media platforms, and partner organizations. Accessing third-party websites is at your own risk, and you should review their terms and policies before engaging with them.

8.1 General Disclaimer

The Site and all content, products, and services provided through it are offered on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The content on the Site, including the book and any associated materials, is provided for informational and educational purposes only. Nothing on the Site constitutes medical advice, financial advice, legal advice, or professional consulting. 8.3 No Guarantee of Results

9. Limitation of Liability

To the fullest extent permitted by applicable law, Fayer Consulting LLC, its owner, officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Site, any purchases made through the Site, or any content on the Site, regardless of the theory of liability.

Our total cumulative liability for all claims arising out of or related to the Site or these Terms will not exceed the amount you paid to us, if any, in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Fayer Consulting LLC, its owner, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any dispute arising out of or related to these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Westchester County, New York. You consent to the personal jurisdiction of these courts and waive any objection to venue.

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us. We will attempt to resolve the dispute through good-faith negotiation within 30 days.

12. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this page. Your continued use of the Site after any modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Fayer Consulting LLC regarding your use of the Site and supersede all prior agreements and understandings, whether written or oral.
